MyConstruct ACCEPTABLE USE POLICY

Purpose
The primary purpose of this Acceptable Use Policy is to ensure the intended, lawful, and ethical use of the MyConstruct Service and any Third Party Content for the benefit of all of Our customers, their clients, and suppliers.
It sets out the things that you can and cannot do with the MyConstruct Service and the Third Party Content as well as providing Us with certain rights to deal with information or uses that are contrary to this Acceptable Use Policy.
Application
This Acceptable Use Policy applies to the self-service MyConstruct product available at myconstruct.com and to all users of that Service. It is incorporated into the Subscription Agreement for that Service, and may be changed by MyConstruct in its discretion from time to time. Any changed version of this Acceptable Use Policy applies from the date that is 60 Business Days after the date that it was posted to the Website.
Enterprise, white-label, and other custom editions of MyConstruct that are sold by direct engagement with Us are governed by separately negotiated contracts with the customer. Those contracts are tailored case by case to reflect the customer’s needs and size of business, and may vary or replace parts of this policy. Where a signed enterprise or custom contract applies, that contract prevails to the extent of any inconsistency with this policy.
Things you must do
You must:
a) use the MyConstruct Service only for the purposes for which we designed it to be used;
b) use the MyConstruct Service strictly in accordance with any instructions made available by Us, including any user documentation or instructions provided via the helpdesk or during any training session provided by Us, or our registered training partners;
c) use the MyConstruct Service in compliance with any law of Australia, including the Privacy Act 1988 (Cth);
d) use the MyConstruct Service in a manner that does not interfere with or harm other users of the MyConstruct Service;
e) use every effort to use up-to-date anti-virus software on any device that connects to the MyConstruct Service;
f) promptly comply with any instruction from MyConstruct to delete or remove any material that, in the opinion of MyConstruct:
i. contravenes this Acceptable Use Policy.
ii. is the result of any lawful instruction from Us to remove content, for example where a third party has issued a Take Down Notice under the provisions of the Copyright Act 1968 (Cth).
g) comply with any request from Us to assist in preventing any breach of this Acceptable Use Policy, or in respect of any legal action that is taken in respect of the MyConstruct Service, the content, or the Website. We will reimburse any out-of-pocket expenses where You provide such assistance, and the cause of the breach or the initiator of the legal action is not You, and We agree to reimburse those expenses in writing in advance.
Content that you must not use
You must not use the MyConstruct Service to, store, display, market, promote or sell any of the following material or data, which in Our opinion:
a) embodies the intellectual property rights (including trade mark, registered, unregistered and common law and copyright, including a creator's moral rights) of a third party such as but not limited to authors, artists, photographers or others, without the express written consent of the owner of such rights, or in any way infringe the intellectual property rights or moral rights of any third party;
b) is personal data or sensitive personal data in breach of the terms of any privacy laws or confidential information in breach of confidence or breaches a person's right to publicity or induces any person to breach a contract;
c) is material that breaches any code of conduct, whether voluntary or otherwise, including any advertising code of conduct;
d) is false, misleading or deceptive or is likely to mislead or deceive;
e) unlawfully exploits persons under 18 years of age;
f) is unlawful (including breaching laws relating to the wrongful distribution of email or other electronic messages “spam”), discriminatory, derogatory, defamatory, slanderous, malicious, obscene, contains child pornography or is immoral;
g) is grossly offensive, including expressions of bigotry, prejudice, racism, hatred or profanity or includes any obscene, lewd, lascivious, violent, harassing or otherwise objectionable content;
h) advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or which provides instruction, information or assistance in causing or carrying out such violence;
i) contains any virus, Trojan horse, worm, ransomware or other programs that have an adverse effect on the Service, our hosting facilities, the internet or other persons' systems, computers, devices, software or data;
j) is used to gain unauthorized access to, does harm to, wrongfully intercepts, expropriates, accesses or uses for any wrongful purpose, any person's hardware, software, network or data.
You must not aid, abet, counsel or procure any of the above.
Things you must not do
You must not use the MyConstruct Service to:
a) store information related to, or display, market, sell or offer to sell, any product or service that is pornography, escort services, illegal goods including illegal drugs, substances and weapons and pirated computer programs, instructions on how to assemble or otherwise make bombs, grenades or other weapons, or any other products, services or content that it is unlawful to sell or offer to sell in Australia or any other country;
b) engage in any libelous, defamatory, scandalous, threatening or harassing activity;
c) breach the provisions of the SPAM Act 2003 (Cth);
d) broadcast unsolicited commercial messages, including emails that are sent to persons who you cannot demonstrate has positively consented to the receipt of that type of message;
e) collect or re-direct responses from unsolicited emails from accounts of other service providers;
f) provide misleading information as to the origin of a message, or alter headings, return email information and/or internet protocol addresses in order to conceal the origin of a message;
g) provide misleading information as to the identity or authority of the person making the posting;
h) distribute any virus, Trojan horse, worm, ransomware or other programs that have an adverse effect on the MyConstruct Service, Our hosting facilities, the internet or other persons' systems, computers, devices, software or data;
i) hack or facilitate hacking;
j) use the Service in a way that is unlawful or deliberately deceptive and intended to cause material harm to Our reputation;
k) scrape, harvest, extract, or otherwise collect data from the MyConstruct Service in a way that is intended to obtain Our product data, pricing, features, documentation, user interface design, or other non-Customer Data for competitive analysis, training competing systems, bulk export outside authorised means, or any similar purpose, including during a trial or evaluation — except that You may freely export, process, and use Your own Customer Data (including with AI tools) using the features and APIs available to Your subscription;
l) use bots, scrapers, crawlers, AI agents, or other automated methods to probe, map, or abuse the MyConstruct Service, to circumvent access controls or rate limits, or to send traffic in a way that interferes with the proper working of the Service — provided that legitimate automated use is permitted as described below;
m) create excessive traffic or engage in conduct that imposes or may impose, in Our sole discretion, an unreasonable or disproportionately large load on our infrastructure (rate limits and similar controls are enforced automatically and must not be circumvented);
n) impersonate any MyConstruct staff or other businesses, or misrepresent yourself or your affiliation with any person or entity;
o) use fake details or provide false information when signing up for the MyConstruct Service;
p) use a trial, free, or evaluation access for the primary purpose of extracting Our product information, benchmarking against Us for competitive purposes, or otherwise evaluating Us other than for Your genuine consideration of a paid subscription.
You must not aid, abet, counsel or procure any of the above.
AI tools, automation and APIs
We recognise that modern businesses routinely use AI assistants, agents, and automation. The following is permitted:
a) using AI tools (including large language models and AI agents) with Your own Customer Data for Your legitimate business purposes;
b) using any API, integration, webhook, or export feature that is available under Your subscription, including from AI agents and automated systems, provided You stay within the rate limits, quotas, and authentication requirements We enforce (those limits are applied automatically and must not be bypassed or spoofed);
c) automating workflows against the Service in the ordinary course of Your business, so long as that automation does not scrape Our product, UI, help content, or other non-Customer Data, and does not interfere with other users or Our infrastructure.
What is not permitted is using AI, bots, scrapers, or automation to take Our data or product intelligence — for example scraping screens, help articles, pricing, feature sets, or trial content to build, train, or improve a competing product or service, or to probe Our systems beyond ordinary authenticated use. Paid subscribers acting in good faith on their own Customer Data and entitled API access are fine; competitive scraping and trial abuse are not.
Electronic Signatures
MyConstruct provides electronic signature functionality through the MyCDocs feature. When using electronic signatures, you must:
a) only sign documents on behalf of yourself or entities for which you have proper authority to sign;
b) provide accurate and truthful information when signing, including your full name and email address;
c) not impersonate another person or entity when providing signature information;
d) acknowledge that electronic signatures are legally binding under the Electronic Transactions Act 1999 (Australia) and Electronic Transactions Act 2002 (New Zealand);
e) understand that signature data and compliance information (including IP address, device information, timestamps, and consent acknowledgment) are collected and stored for legal compliance and audit purposes;
f) not attempt to alter, forge, or tamper with signature data or compliance information stored by the MyConstruct Service;
g) not use electronic signatures for fraudulent, illegal, or unauthorized purposes;
h) ensure that any document you sign electronically is appropriate for electronic signature under applicable law.
You acknowledge that electronic signatures created through the MyConstruct Service have the same legal effect as handwritten signatures, subject to applicable law. You are responsible for ensuring that electronic signatures are appropriate for the documents you are signing and that you have the authority to sign such documents.
MyConstruct stores signature data and compliance information securely in accordance with legal requirements. This information may be used to verify the authenticity of signed documents and to provide an audit trail if required for legal or compliance purposes.
Responsible Disclosure of Bugs and Security Flaws
We are committed to maintaining the security and integrity of the MyConstruct Service. If you discover any bugs, vulnerabilities, or potential security flaws, we encourage you to report them to us responsibly. Please adhere to the following guidelines:
a) Do not exploit any discovered vulnerability for any reason, including gaining unauthorized access to data, conducting denial-of-service attacks, or compromising the security of the MyConstruct Service or its users;
b) Provide a detailed description of the vulnerability, including steps to reproduce it, to help us understand and address the issue promptly;
c) Do not disclose the vulnerability to any third party or make it public until we have had a reasonable opportunity to investigate and address the issue;
d) Only use the official channels provided on our website to report security issues. You can contact us through the Contact Us page;
e) Respect the privacy and data of our users. Do not access, modify, or delete any data without explicit permission;
f) Understand that we do not have a formal bug bounty program, but we appreciate your cooperation in helping us maintain the security of our platform.
We take security seriously and will investigate all reported vulnerabilities promptly. Your assistance in responsibly disclosing vulnerabilities helps us ensure the safety and security of our users and the MyConstruct Service.
If you do not comply with this Policy
We do not actively monitor the MyConstruct Service, the content that is loaded into it or any content provided by any Third Party Provider, nor do We exercise active supervision over the MyConstruct Service, the content that is loaded into it or any content provided by a Third Party Provider, nor do We monitor the MyConstruct Service, the content that is loaded into it or any content provided by a Third Party Provider to determine whether there has been any failure to comply with the Acceptable Use Policy.
If We become aware of a breach, or threatened breach, of the Acceptable Use Policy, then, in addition to any remedy We may have under any agreement with you, We may take any action that We deem, in Our unfettered discretion, prudent or necessary to prevent or remedy that breach, including immediately and without notice:
a) preventing access to any user or group of users, and/or
b) intercepting, removing or altering any content stored in the MyConstruct Service;
c) disconnect any link to any content provided by a Third Party Provider.
Capitalised Terms
The capitalised terms in this Acceptable Use Policy have the same meaning as in the Agreement We have with You.
